SMS Policy & 10DLC Compliance

Purpose
This document outlines how Ciro Hernandez / Rize Mortgage obtains client consent to receive SMS notifications about their mortgage applications, in full compliance with 10DLC, TCPA, and CTIA guidelines.
Opt-In Consent
We obtain your express written or verbal consent to send SMS messages through one or more of the following methods:
Method 1: Digital Consent (Web Form)
When you fill out a form on our website, you'll see an optional, unchecked checkbox:

"By providing your phone number, you are opting into marketing texts. Message frequency may vary. Standard message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Method 2: Verbal Consent (Phone or In-Person)
This method uses a double opt-in process as required by carriers for marketing messages. When you call (908) 209-8194 or visit our office, our representative will read the following script:
Agent states to customer:
"Would you like to sign up for SMS notifications from Close With Ciro so we can send you application status updates, document requests, and exclusive offers? By providing your phone number, you are consenting to receive SMS notifications and marketing messages via text. Message frequency may vary. Standard message and data rates may apply. You can text HELP for support or STOP to unsubscribe at any time. We won't share your mobile information with third parties for marketing. You can also find our privacy policy on our website at closewithciro.com/privacy-policy."
Customer Response: "Yes, I agree."
Confirmation SMS Sent:
Close With Ciro: You have agreed to receive SMS updates from Ciro Hernandez. Msg frequency varies. Msg & data rates may apply. Reply STOP to unsubscribe, HELP for help. To confirm you also want to receive marketing messages please reply YES
If user replies YES:
Close With Ciro: Thanks, you've now been subscribed to SMS notifications, including promotions. Msg frequency varies. Msg & data rates may apply. Reply STOP to unsubscribe or HELP for help.
If user does NOT reply YES to the marketing confirmation, they will only receive informational messaging (not promotional).
Method 3: Opt-In by Keyword
Text one of the following keywords to (908) 209-8194 to opt in:

Method 4: Opt-In by Inbound Message
When you text any message to (908) 209-8194 (published on our website, business cards, flyers, and email signatures), the system responds with:

Types of Messages You May Receive
When you opt in to receive SMS messages from us, you may receive:
- Application status updates – Progress on your mortgage application
- Document requests – Notifications when we need additional documentation
- Rate-lock confirmations – Confirmation of your interest rate lock
- Closing date reminders – Important dates and deadlines
- Market insights – Updates on market conditions and rates
- Exclusive opportunities – Marketing messages and promotional offers
Message Frequency and Data Rates
Message frequency varies based on your transaction activity. You may receive approximately 2-8 messages per month. Standard message and data rates may apply depending on your mobile carrier plan.
How to Opt Out (STOP)
You can opt out of SMS messages at any time. Reply to any message with one of these keywords:
Opt-out requests are processed immediately. You will receive a confirmation message acknowledging your request.
Help and Support (HELP)
Reply HELP or INFO to any message to receive assistance:

Supported Carriers
Our SMS messaging service is compatible with all major U.S. mobile carriers, including but not limited to:
Carriers are not liable for delayed or undelivered messages. T-Mobile is not responsible for delayed or undelivered messages.
Privacy and Data Protection
- We will not sell or share your mobile phone number with third parties for promotional or marketing purposes
- Your SMS data is protected in accordance with our Privacy Policy
- All consent records are stored securely with timestamps
- Your phone number is only used for the stated SMS communication purposes

All digital, verbal, keyword, and inbound message consents are stored in our CRM with timestamps indefinitely to meet TCPA, CTIA, 10DLC, NMLS, and CFPB requirements.
Regulatory Compliance
10DLC Requirements
All campaigns are registered with mobile carriers and comply with carrier-specific requirements.
TCPA Compliance
Express written consent is obtained before sending marketing messages. Consent is not a condition of purchase.
CTIA Guidelines
We follow industry best practices for mobile messaging, including clear opt-in and opt-out.
NMLS Requirements
All communications meet record-keeping and disclosure requirements for mortgage communications.
